By accessing or using LendAutomate's platform and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

LendAutomate provides a cloud-based private lending platform that includes loan origination, loan servicing, fund management, and automation tools for private lenders operating in the United States and Canada.

3. Account Registration

To use our services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Payment

Access to LendAutomate's platform requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law.

5. Acceptable Use

You agree not to use our services to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or interfere with our systems
  • Engage in fraudulent activities
  • Violate any consumer protection or lending regulations

6. Data Ownership

You retain all rights to the data you input into LendAutomate. We process your data solely to provide our services. Upon termination, we will provide you with an export of your data within 30 days.

7. Limitation of Liability

To the maximum extent permitted by law, LendAutomate shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the platform. Continued use of our services after changes constitutes acceptance of the new Terms.
